December 6-9, 2011 the plenary session of the Council of Judges of the Russian Federation was held in Moscow.

     In the work of the Council took part: Chairman of the Supreme Court of the Russian Federation Lebedev V.M., Chairman of the Higher Arbitration Court of the Russian Federation Ivanov A.A., Chairman of the Supreme Qualification Collegium of the Russian Federation Kuznetsov V.V., Chief of the State service and Personnel Office of the President of the Russian Federation Dubik S.N., Adviser to the President of the Russian Federation Yakovlev V.F., Adviser to the President of the Russian Federation and Chairman of the Presidential Council of the Russian Federation for Civil Society Development and Human Rights Fedotov M.A., General Director of the Judicial Department of the Supreme Court of the Russian Federation Gusev A.V., Deputy Chief of the Office – Chief of the Department of the Human Resources Policy in the Judicial System of the State service and Personnel Office of the President of the Russian Federation Suslov N.N., Rector of the Russian Academy of Justice Ershov V.V.

     Chairman of the Supreme Court Lebedev M.V. noted in his speech the needs of legislative consolidation of the possibility of distribution of cases between justices of peace of different parts of a district court and the possibility of preparing of reasons for judgment only by request within 3 days, proposed to increase the amount of claims for recovery of taxes and fees - from 1,500 to 3,000 rubles. In his speech he spoke about the involvement of retired judges to work in magistrate court regardless of borders of the judicial district of constituent entities of the Russian Federation and raised the question of the possibility of transferring cases of administrative offences, which provides the imposition of a fine, to the executive branch. Chairman of the Supreme Court thinks that new machinery of the announcement only the resolution part of sentencing for economic crimes and private sessions significantly will reduce the burden on judges.

     Chairman of the Higher Arbitration Court of the Russian Federation Ivanov A.A. proposed to count work time provided by the law in the length of service of a judge with the condition of judicial tenure for at least 10 years, and to introduce time of compulsory work on general civil positions for at least 5 years for candidates for a judge. Head of the Higher Arbitration Court of the Russian Federation noted the need of expanding the list of disciplinary actions, creating interregional judicial presences, endowing the higher courts with exclusive authority to amend submissions on judges of lower courts. He pointed to the creation of prerequisites and conditions in case of the possible restrictions of independence of judges, among them: improving the impartiality and independence of law enforcement personnel from their management personnel, reforming the operational-investigative activity and posting of court chairmen and their deputies by court plenums.

     Adviser to the President of the Russian Federation and Chairman of the Presidential Council of the Russian Federation for Civil Society Development and Human Rights Fedotov M.A. noted a decline in judicial journalism, setting the example of renowned journalists of the Soviet era and suggested to the Council of Judges of the Russian Federation to work more closely with the Presidential Council of the Russian Federation for Civil Society Development and Human Rights, and also to devote the next meeting debating the topic of people’s staying in a pre-trial detention center.

    General Director of the Judicial Department of the Supreme Court of the Russian Federation gave the summary report for 2011 in which he told about the problems of financing and material - technical support. He proposed to actively introduce the principle of the planning target for the most effective use of budgetary funds, while he noted a positive trend in providing activity of the judicial system. Gusev A.V. reported about the completion of the creation of the common informational space and positive effect of informatization on the courts, about the need for additional measures to ensure the safety of judges and to continue work on closing down of minor composition courts.

     Rector of the Russian Academy of Justice V.V. Ershov speaking on the reorganization of examination commissions in view of the reform of the formation of the judiciary establishment said about the need of continuity in the election of new regional commissions and the need to include the Russian Academy of Justice in the Federal target program "Development of the Russian judicial system in the years 2013-2017" to improve the quality of education of judges.

After reports of chiefs of the higher courts, members of the Council discussed submitted law drafts.

The meeting discussed the following issues:

  • On the draft federal law "On Amending the Federal Law "Concerning Additional Guarantees of Social Protection for Judges and Administrative Staff of Courts of the Russian Federation "(in terms of determining the length of service as a judge).
  • On preparation of the draft federal law "On Amendments to Certain Legislative Acts of the Russian Federation with regard of improving the remuneration system of judges of the Russian Federation."
  • On progress in developing of the draft concept of the federal target program "Development of the Russian judicial system in the 2013-2017 years".
  • On issues related to adoption of the Federal Law of June 4, 2011 № 126-FZ "On guarantees of pension provision for certain categories of citizens."
  • On results of the implementation of the order of the President of the Russian Federation of December 15, 2010 № Pr-3645 of increasing openness and accessibility of justice in the Russian Federation.
  • On the Model Regulations on awarding judges of courts of general jurisdiction, and provide them with material assistance.
  • On organizational provisions of the introduction of the institutional appeal in the supreme courts of republics, krai and oblast courts, courts of federal importance, courts of autonomous oblast and courts of autonomous areas, district (fleet) military courts.
  • On the possibility of mediation in the work of the Russian judge on the implementation of the Federal Law of July 27, 2010 № 193-FZ "On alternative dispute resolution process involving mediation (mediation procedure)."
  • On amendments to the Appendix № 2 of the Resolution of the Council of Judges of the Russian Federation dated May 24, 2011 № 272 (the formation of the Higher Qualification Collegium of the Russian Federation).
  • On holding of the VIII All-Russian Congress of Judges.  

The Council of Judges approved a number of resolutions which will be posted in the section entitled “Resolutions”.
